1. Preamble

The following general terms and conditions of sale govern all transactions established on the MR RETAIL SARL web catalog. Any order placed on this site implies the customer's unconditional and irrevocable acceptance of these conditions.

2. Object

This contract is a distance contract which aims to define the rights and obligations of the parties in the context of the sale of products of the company MR RETAIL SARL on the Internet, through the secure online payment platform of the Interbank Payment Center.

nyscollection.ma is a service and a trademark registered by MR RETAIL SARL.

3. Definitions

In the remainder of the contract, each of the expressions mentioned above will be understood in the sense of its definition, namely:

• “Distance contract”: any contract concerning goods or services between the Company MR RETAIL SARL and a Consumer within the framework of a distance sales or service provision system organized by the Company MR RETAIL SARL which, for this contract, exclusively uses the Internet network until the conclusion of the contract, including the conclusion of the contract itself.
• “Consumer”: any natural person who, in this contract, acts for purposes which are outside the scope of his professional activity.
• “Purchase order”: document which indicates the characteristics of the Products ordered by the Consumer and which must be signed by the Consumer by “double click” to commit the Consumer.
• “Order”: act by which the Consumer agrees to purchase Products and the Company MR RETAIL SARL to deliver them.

4. Product

All products in the catalog are sold while stocks last. MR RETAIL SARL reserves the right to remove an item from the catalog without notice. It cannot under any circumstances be held liable for compensation or cancellation of an order due to the inability to use the purchased product due to incompatibility with the equipment already owned by the buyer.

5. Place an order

After finding the product(s) that interest you, click on the "order" button, the product is then added to your order form.
You can modify your order form at any time and you can return to the catalog by clicking continue shopping.

When you have finished your purchases, validate your order by clicking on the ''pay'' order button.

In case of error on your part, when entering your information on the order form, we advise you to send us a cancellation request by email within 24 hours. After cancellation of the order by MR RETAIL SARL, you can order again.

6. Price

The prices mentioned in the catalog are indicated in Moroccan dirhams including tax, are valid at the time of their consultation by the customer and are those in force at the time of the order.

VAT is calculated in the order form based on the rate applicable on the day of the order. The order form and transactions are made in Moroccan dirham.

Any change in the rate will be automatically reflected in the price of the products.

7. Execution of the order

The order will be executed at the latest within 7 days from the day following that on which the Consumer placed his order.

In the event of unavailability of the Product ordered, the Consumer will be informed as soon as possible and will have the option of cancelling his order.

He will then have the choice of requesting either the reimbursement of the sums paid within thirty days at the latest of their payment, or the exchange of the Product.

8. Delivery

Delivery is not provided by MR RETAIL SARL. The customer will collect their goods from the delivery address indicated on their Order Form.

The Products are delivered to the address indicated by the Consumer on the Order Form. The Consumer is required to check the goods upon delivery and to report any damage caused to the carrier on the delivery note as well as to MR RETAIL SARL within one day.

The Consumer may, at his request, obtain the sending of an invoice to the delivery address by validating the option provided for this purpose on the Order Form.

How much does delivery cost?

Shipping costs are the responsibility of the buyer,

• In Morocco and abroad, they are based on the rates of Poste du Maroc for registered mail.
• Our prices include tax and are calculated based on the weight of the products.
• The cost of transporting your delivery is indicated on your invoice.
• It decreases with the quantity ordered. It is best to group your orders.

What are the delivery times?

After receipt of your payment, your order will be shipped within 48 hours, subject to available stock.

In Morocco and abroad, the items will be sent to you by registered post.
Any delays shall not give rise to damages, cancellation of the order or refusal to take delivery.

9. Payment method

To pay for your order, you choose the payment method among those offered by MR RETAIL SARL on the payment page.

In this case, the transaction will be debited from your account within the day following the date of delivery confirmation.

Your online payments are secured by the Interbank Payment Center (CMI) which offers a fully secure payment service.

The Consumer guarantees to MR RETAIL SARL that he has any authorizations that may be necessary to use the payment method chosen by him, when validating the Order Form.

In the event of payment by bank card, the provisions relating to fraudulent use of the means of payment provided for in the agreements concluded between the Consumer and the issuer of the card and between the Company MR RETAIL SARL and its banking establishment apply.

10. Data Privacy

The information requested from you is necessary to process your order and is treated confidentially.
You have the right to rectify data concerning you.

11. Exchange Policy

If you are not satisfied with the chosen product, you can exchange it for another product of your choice within 15 days. However, only goods returned in perfect condition for resale, complete and in their original packaging (unopened) can be exchanged.

13. Guarantee

All products sold in the catalog are guaranteed against manufacturing defects and material defects. The duration of this warranty is 15 days. This warranty does not cover damage resulting from accidents, misuse or negligence.

NYS ELITE Eyewear range comes with a lifetime conditional warranty, an ELITE pair can be exchanged at any time for a pair of the same style identical to the damaged pair, paying an exchange fee of 250 DHS. All requests are subject to product availability. If the requested item is out of stock or no longer available, NYS Collection will provide a similar style in its place.

14. Proof of transactions paid by bank card

The data recorded by the CMI on the online payment platform on behalf of MR RETAIL SARL constitutes proof of commercial transactions between you and the company MR RETAIL SARL.

15. Force majeure

MR RETAIL SARL is only liable for the performance of its obligations to the extent that no force majeure event hinders them.
